EPC not fully reflected in SAT-3 translation

The SAT-3 r05b text contemplates the possibility that ACS-3 EPC may not be
supported, but ... The possibility that EPC might be disabled is totally
overlooked. As far as I can tell:
  *   MODE SENSE should work if EPC is supported but disabled (i.e., the ATA
Power Conditions log is unique in that it must be readable even if EPC is
disabled (see

ate_log_support_requirements.pdf)); but
  *   MODE SELECT commands would have to be terminated with CHECK CONDITION
status unless EPC is enabled. The only alternative would be to require MODE
SELECT commands for the Power Condition mode page to enable EPC if it is
supported.
Has this issue been discussed before?
Are there any opinions regarding how the SAT-3 translation should be
(re)written?
