Well actually both the drive and the HBA must know what speeds were agreed to or
the bus typically hangs.

I chose to request it from the devices as operating systems hide lots of that
information and you have to do custom calls into the driver.  That would require
for every controller out there a modified driver for each operating system.  The
data you would have to get back is on a device basis since you have to check the
fastest device you have to see if the bus can keep up.  Sounds like a lot more
work to me,
